We thank you for your interest in our Product and for your visit to the
Company's website/app (hereinafter the "Product").
Consent to Terms of Service
The use of the Product indicates your agreement to the Terms of Service
as set forth in this document (hereinafter "Terms of Service") and to
any law/regulation applicable to the use of the Product. If you do not agree to
these Terms of Service, please refrain from using the Product, or contact us so
that we can assist you in alternative ways, to your satisfaction.
Use of the System
The Product includes its texts, interfaces, designs, ideas, services,
features and information (hereinafter the "Content"/"Product
Content"). This Content is intended for your service and use, allowing you
to save the details of the deceased and receive a reminder of their death
anniversary. Anything performed with this Product based on this Content is done
at your sole discretion and responsibility, and you are prevented from claiming
any agreement was made for the Product’s Content to contain certain information
or not specify certain information. You are aware that as a result of using the
Product, some information regarding yourself may be stored in the Company's
systems. The Product’s Contents do not grant you, neither explicitly or
implicitly, any right other than those set forth in this Agreement.
Prohibited Usage of the System
Without the Company’s explicit prior written consent, you may not
perform the following procedures/actions while using the Product and the
Product’s Content **:
• Commercial use of the Product or Product Content;
• Copying, reproducing, modifying, processing, translating,
re-engineering, distributing, transmitting, displaying, performing,
duplicating, publishing or storing the Product’s Contents, as a whole or
partially;
• Activating or enabling the activation of any computer application or
any other means, for the purpose of searching, scanning, copying or
automatically retrieving the Product’s Content;
• Displaying the Product’s Content in a visible or hidden iframe, or
displaying the Product’s Content in any way, including via any kind of software,
device, accessory or Internet Protocol which change the original design of the
Product and/or omit parts;
• Disrupting or violating any right of another user of the Product,
including the right to privacy and/or collecting personal information about the
users of the Product without their explicit prior written consent, including
via automatic means;
• Infringing the dignity or privacy of another user and/or using the
Product and/or Product’s Content to offend any person and/or to publish
incitement, fraud, deception, slander and/or any other information that is
untrue, unreliable or which intentionally offends another person;
• Use of the Product or the Product’s Content to create a database
and/or to collect data.
** Failure to comply with these restrictions may lead to the prevention
of the user's access to the Product and even expose him to civil and/or
criminal liability, according to any law and legislation.
Product Availability, Denial of Access And Company Warranty
The Company has made every effort to provide a quality and safe Product.
However, the Product is not immune to glitches and/or problems, and it is
possible that you won’t have access to the Product from time to time.
The Company may permit or prohibit the user's access to the Product at
any time and at its sole discretion, and retains the sole right to change or
terminate the Product’s operation, in whole or in part, at any time and without
prior notice.
The Product and the Product’s Content can be used as-is, and the Company
may change and/or update and/or delete any Content, be it the Product’s Content
itself or Content uploaded to the Product by you, and/or by someone on your
behalf, and/or by Product users, and/or third parties. The Company assumes no
responsibility and will not be liable for information and/or Content provided
to the Product by you, and/or by anyone on your behalf, and/or by users of the
Product, and/or third parties. The Company is not committed to store
information and/or Content provided to it by you and/or by anyone on your
behalf and/or by users of the Product and/or third parties.
The Company is not liable to you or any third party for any change,
interruption, or termination of the Product’s activity, its services and/or
software. Similarly, the Company will not be responsible for loss of revenue
and/or loss of profits and/or loss of customers and/or any damage caused, or
claimed to be caused, to you or anyone on your behalf as a result of using the
Product, or lack of use of the Product.
Although the Company makes every effort to present in the Product the
most accurate and reliable information possible, the Company is not and will
not be responsible, directly or indirectly, for the availability, truthfulness,
reliability, and/or accuracy of the Content appearing in the Product. Any
reliance on the Product and/or the Product’s Content is made at your sole
discretion and responsibility. The Company will not be responsible or liable
for compensation and/or assistance for any damage, direct and/or indirect,
which may be caused by your use of the Product, and/or your reliance on this
information or other information contained therein, and this use is at your own
risk.
Privacy of Website and Databases
The Company respects your privacy and is committed to maintaining the
rules of privacy protection recognized in Israel. For more information on
privacy measures, enter the Product and click on the "Privacy Policy"
tab.
Without derogating from the terms of the Company's privacy policy, any
information you provide and/or collect about yourself when you use the Product
and/or the Product’s Content, directly or indirectly, is with your consent and
authorisation, and it is possible that the information will be stored in the
Company's registered databases in accordance with the Company's privacy policy.
You are not required by law to provide this information, but if you
choose not to do so you will not be able to enjoy the use of this Product.
Important Note: All the data of the deceased entered into the
"Kaddish Forever" system will be visible and can be seen by the other
users when searching for the name of the deceased, but it is not possible to
change the details of the deceased that you saved in the system.
Intellectual Property
All intellectual property rights in the Product and the Product’s
Content, including design, source code and binary code, trademarks, computer
software, concepts, confidential information, trade secrets, service and trade
icons, copyrights, databases, derivative works, discoveries, formulas,
goodwill, ideas, improvements, samples, information, innovations, inventions,
knowledge, logos, market data, methods, moral rights, literary works, graphic
file, trade names, technical information and any equivalent or derivative right
to any of the aforesaid belong solely to the Company, or of a third party who
granted the Company the right to use them, and their use is prohibited without
the Company’s explicit prior written consent.
All Content contained in the Product, including text, images, graphics,
sound files, animation files, video files, and how they are organized, are all
subject to copyright and other intellectual property and privacy protections.
You may not use, copy, reproduce, duplicate, process, distribute, display or
publish Content from the Product, or make any use of it for commercial or
private purposes, by you or by anyone else on your behalf, without the
Company’s explicit prior written consent. Some of the Product’s Contents may
even contain information, symbols or content subject to the copyright of
external manufacturers and/or suppliers and/or companies connected with the
Company.
Unless specifically stated otherwise, all icons and symbols appearing on
any of the "Sites" or "Apps," or the "Software"
or "Systems" or Tools or Services that have been provided, are
provided or will be provided to you through the Company (hereinafter: the
Company’s “Technological Services"), are subject to the rights of the
Company's trademarks, including plates and model names as well as the Company’s
logo, its symbols, and its brand’s logo and symbols.
Product Versions, Prices and Licenses
It is possible that some of the Content, information, symbols, charts or
images contained in the Product and relating to the Products and/or services
displayed or offered in it, have been prepared for general needs for the system
or are held in various countries around the world. Accordingly, some of the
information and/or accompanying elements, which are not available in some
countries, or are intended to meet the requirements of the domestic market or
the supervisory authorities in those countries, may only be available in
specifications or other configurations.

Cancelling a Transaction
Cancellation of a transaction will be in accordance with the Consumer
Protection Regulations (Cancellation of a Transaction) 5771/2010, and the
Consumer Protection Law, 5741/1981
Compliance with Conditions and Indemnification
The user hereby undertakes to comply with all provisions of the law,
including any law and/or regulation that may apply to use of the source and/or
the software, including these Terms of Service. You also undertake to indemnify
the Company and/or anyone acting on its behalf for any damage, payment or
expense caused to them, directly or indirectly, including damage to goodwill,
financial and/or commercial damage, attorney's fees and reasonable legal
expenses, In respect of any claim, demand and/or claim brought against them by
any third party as a result of improper and/or illegal use by you of the
Product and/or software, including violation of these Terms.
Data Security
The Company does all in its power and uses advanced technological and
organizational security measures to secure its Products, communications and the
information under its control, against accidental or intentional exploitation,
loss or destruction, or against access by unauthorized or unsanctioned persons.
The communication between the user’s computer or mobile device, or a visitor to
the system and the Company's servers, is secured using accepted encryption
methods, in accordance with the agreed standards. Similarly, the Company takes
reasonable measures to protect its products, hardware and software components
related to their operation, and takes care to update them regularly, inter
alia, to protect its products and software from intrusions, hackings or
unauthorized eavesdropping.
Notwithstanding the foregoing, the Company cannot guarantee the complete
security and protection of the information and does not guarantee that its
services will be completely immune from unauthorized access to the information
or Content stored. Therefore, it is hereby clarified that the Company will not
be liable and will not bear any responsibility in the event of intrusion or
hacking and/or any damage caused to its products and/or software, by the user
of the system or anyone on his behalf.
Jurisdiction
Only the law of the State of Israel shall apply to any use of the
Product and/or to any claim, demand or request arising from this use and/or
from anything else directly or indirectly related to the Product. The place of
jurisdiction will only be in the Tel Aviv court, Israel, and the substantive and
procedural law that will apply will be Israeli law.
Changes in Terms of Service
The Company reserves the right to change, delete and/or add to these
Terms of Service at any time and without obligation to give prior notice and/or
retrospective notice. Any addition and/or change made to the Product, the
Product’s Content and/or these terms will bind you as you continue to use it.
Accordingly, we advise you to review these Terms from time to time. Your use of
the Product after making the changes indicates your consent to these changes.
If you do not agree to the changes, please refrain from continuing to use the
Product, or contact us for alternative solutions.
Miscellaneous
The Terms of Service do not and will not be construed as creating any
partnership, joint venture, employer-employee relationship, agent or mediator
agreement between you and the Company.
If any of the Terms of Service is found to be illegal, void or
unenforceable for any reason, this Terms will be deleted from the Terms of
Service and its deletion will not affect the legality and validity of the
remaining Terms of Service. In such a case, the existence of a similar
condition will be seen as enforceable instead of the condition that has been
deleted or removed.
These Terms of Service constitute the complete agreement between you and
the Company regarding the manner in which the Product is used, and they replace
any other understanding and/or consent, oral or written, regarding the use of
the Product and the Product’s Content.
